The Reform and Integrity Act of 2022 (RIA) requires that EB-5 transactions need to be either audited or controlled by a fund administrator that is independent of the new commercial enterprise, regional center and job-creating entity, and must be a licensed CPA, attorney or broker-dealer.

EB-5 Immigrant Investor Program

The United States Congress created the employment-based immigration fifth preference (EB-5) visa category in 1990 for qualified foreigners seeking to invest in a business that will benefit the U.S. economy and create or save jobs for U.S. workers. The EB-5 program authorizes up to 10,000 green cards (U.S. permanent residence visas) per year for foreign individuals who make a qualifying job-creating investment. The program is administered by the United States Citizenship and Immigration Services (USCIS) and gives investors an opportunity to rapidly obtain a green card in exchange for making a qualifying, job-creating investment in the U.S. The investment amount is currently $800,000 for investments in certain specially qualifying areas and $1,050,000 elsewhere.
