Jack has over 30 years of experience in bankruptcy and financial distress-related matters, and fraud and forensic investigations, providing consultation and expert witness services in the areas of business restructuring, bankruptcy and insolvency taxation (federal, state, and local), public finance, fiduciary duties and governance issues, directors and officers (D&O) liability matters, related-party transactions, intercompany transfers, international asset concealments, fraudulent transfers, remedies, forensic accounting and fraud investigations, and commercial and intellectual property (IP) damages modeling.

He has served in a fiduciary role or as a consultant and testifying expert witness in numerous national and international bankruptcy and insolvency proceedings and national and international commercial disputes. 

Jack is a tenured professor at Georgia State University College of Law and the Middle East Studies Center in Atlanta, Georgia, where he teaches and conducts research in the areas of business reorganizations, forensic accounting and financial investigations, mergers and acquisitions, corporate finance, taxation, and law and statistics.

He is presently the Resident Scholar of the Association of Insolvency & Restructuring Advisors (AIRA) and served two terms as the American Bankruptcy Institute (ABI) Resident Scholar.  In these roles, he has researched a range of forensic investigation, fiduciary duty and governance issues, solvency, distressed business valuations, profit and profitability assessments, and international asset concealment schemes.

Jack has testified before US House and Senate Committees and Subcommittees, and Georgia House and Senate Committees and Subcommittees. Jack is based in Atlanta, Georgia.

  • In re Seadrill Limited, et al., financial advisors to the Disinterested Directors of the Board of Directors of Seadrill Limited. Expert testimony by declaration.  Subject matter included valuation, related party transactions, potential fraudulent transfers, potential breach of fiduciary duties, and damages.
  • In re Caesars Entertainment Operating Company, et al., financial advisor to the Special Governance Committee. Expert testimony by declaration.  Subject matter included valuation, related party transactions, potential fraudulent transfers, potential breach of fiduciary duties, and damages.
  • In re Energy Future Holdings Corp., et al., financial advisor to the Indenture Trustee for certain notes issued by Energy Future Holdings Corp.  Expert report, testimony by deposition and trial testimony regarding valuation, taxation, confirmation of Plan of Reorganization.
  • In re Sabine Oil & Gas Corporation, et al., financial advisors to the Independent Committee of the Board of Directors.  Expert report, testimony by deposition and trial testimony regarding solvency and reasonably equivalent value.
  • Tronox Incorporated, et al., v. Anadarko Petroleum Corporation and Kerr-McGee Corporation, et al., litigation support on behalf of plaintiff.  Expert report and testimony by deposition and trial.  Subject matter included reasonably equivalent value, damages, market evidence of insolvency.
  • Adelphia Communications Corp., et al., v. FPL Group, Inc. and West Boca Security, Inc., litigation support on behalf of defendant.  Expert report and testimony by deposition and trial regarding reasonably equivalent value.
  • ASARCO, LLC v. Sterlite (USA), Inc. and Sterlite Industries (India) Ltd. (In re ASARCO, LLC, et al.), litigation support on behalf of defendant.  Testimony by deposition and at trial regarding damages.

  • Hoyd v. Trussway Holdings, LLC, Court of Chancery of the State of Delaware, litigation support on behalf of the defendant.  Expert testimony in trial regarding valuation for appraisal rights.
  • In Support of Georgia Power Company’s Seventeenth Semi-Annual Vogtle Construction Monitoring Report, Georgia Public Service Commission.  Retained by Georgia Power to provide expert testimony in an administrative proceeding regarding the reasonableness of actions taken by Georgia Power in light of Westinghouse Electric Company LLC and certain of its affiliated companies’ bankruptcy filing.
  • New Jersey Department of Environmental Protection, et al., v. Occidental Chemical Corporation, et al., Superior Court of New Jersey Law Division – Essex County.  Retained by YPF, S.A., YPF Holdings, Inc., and YPF International, S.A. Provided expert report, testimony by deposition regarding alter ego, asset stripping.
