The implementation date of the health plan-specific components of the Interoperability and Patient Access final rule (CMS-9115-F) are now in effect. However, as was communicated in September 2021 by the Centers for Medicare & Medicaid Services (CMS), enforcement of the payer-to-payer data exchange component of the law has been delayed. With interoperability being emphasized more than ever before, health plans should continue to work towards compliance with all aspects of the law and think beyond a pure compliance standpoint, despite this most recent delay in enforcement.
